Delhi HC Supports Telegram Ban Amid NEET-UG Concerns

The Delhi High Court recently upheld the Indian government's decision to impose a temporary ban on the messaging platform Telegram, primarily aimed at preventing cheating during the NEET-UG re-examination. This ruling highlights the government's efforts to maintain the integrity of the examination system amidst rising concerns over cheating incidents.

Justice Tejas Karia presided over the case and concluded that the government's justification for the ban was adequate, stating that they had followed the necessary legal procedures outlined in Section 69A of the Information Technology Act. The court found that the reasons provided by the government were sufficient to support this urgent measure.

The temporary ban on Telegram will remain in effect until June 22, as per the government's order. This decision comes after multiple reports indicated that organized cheating groups were using Telegram to share leaked exam materials and coordinate dishonest practices, undermining the examination's fairness.

Telegram challenged the ban, arguing that it was unconstitutional and disproportionately impacted its 150 million users in India. The platform claimed that the government's action was overly broad and lacked a solid basis in law. However, the court rejected these arguments, emphasizing that the measures taken were necessary to address the immediate threat posed by potential cheating during the exam.

In its ruling, the court stated that the government was empowered under Section 69A to block access to platforms like Telegram in the interest of public order and national security. Justice Karia noted that the government had demonstrated a proportional response to the issue at hand, asserting that the suspension was a targeted measure intended to curb misuse during the NEET re-examination process.

The high court also found that both the initial blocking order and the subsequent decision by the Review Committee were reasoned and showed that authorities had properly considered the relevant issues. The court's decision underscores the delicate balance between maintaining public order and ensuring the rights of users in the digital space.

As the situation unfolds, it remains crucial for both the government and platforms like Telegram to work collaboratively to address the challenges posed by online cheating, while also respecting the rights of users. The outcome of this case could set a precedent for how digital platforms are regulated in the context of national examinations in India.
