New Scrutiny on M&A Deals Over Rs 2,000 Crore Under Competition Act

The Indian government has introduced a new provision under the Competition Amendment Act 2023, focusing on mergers and acquisitions (M&As) with a deal value exceeding Rs 2,000 crore.

Effective from September 10, this move aims to scrutinize transactions that may bypass traditional asset or turnover-based thresholds, especially in digital markets. The Ministry of Corporate Affairs (MCA) will soon issue detailed regulations. Additionally, companies with 10% or more shareholding or access to sensitive information will be considered affiliates under the new rules
