Trump's Tariff Battle: Legal Setback or Economic Strategy?

31 Aug, 2025

US President Donald Trump has recently expressed strong opposition to a ruling by a US Appeals Court that declared most of his tariffs as unlawful. The ruling poses a significant challenge to one of his key economic policies, which he argues is vital for protecting American jobs and businesses. Trump insists that these tariffs are essential for the economic strength of the United States, stating that their removal would lead to financial disaster.

The Appeals Court allowed the tariffs to remain in place until a challenge can be made in the Supreme Court. Trump took to social media to assert that “ALL TARIFFS ARE STILL IN EFFECT!” He emphasized the importance of tariffs in combating enormous trade deficits and unfair trade practices imposed by other countries, whether they are allies or adversaries.

According to Trump, the ruling from the court is misguided and does not reflect the needs of the American economy. He believes that without these tariffs, the United States would become financially weak and vulnerable to exploitation. He stated, “If these Tariffs ever went away, it would be a total disaster for the Country.”

In his remarks, Trump also highlighted that tariffs serve as the best tool to support American workers and companies that produce goods domestically. He criticized past politicians for allowing tariffs to be used against the US and expressed confidence that with the help of the Supreme Court, he would turn the situation around for the benefit of the nation.

The US Court of Appeals ruled that Trump had overstepped his authority by imposing certain tariffs under emergency powers. They pointed out that while the President has significant power during a national emergency, this does not explicitly include the authority to impose tariffs. This ruling particularly affects the so-called “reciprocal” tariffs introduced during his trade war, which targeted countries like China, Canada, and Mexico.

The decision was reached following two lawsuits filed by small businesses and Democratic-led states, all arguing that only Congress has the power to impose taxes and tariffs. The outcome of this case could have lasting implications for US trade policy and the future of Trump's economic agenda, making it a closely watched issue as it moves to the Supreme Court.
